Secure leases granted before April 1, 2012 can only be transferred or passed on once. For example, if you take out a lease, if someone dies, you cannot pass the lease on to someone else if you die. The request must be made in writing and within 21 days of the offer of the lease, unless the landlord of the commune accepts in writing a longer period of time. The regulations define the procedure to be followed during the review.  As a safe tenant, you can normally reside in the property for the rest of your life, unless you break the rental conditions. This is usually for at least 5 years, although in some cases it can be between 2 and 5 years.

As a general rule, you have a secure Scottish lease when you rent your home to the Council, a housing company or a housing co-op in Scotland.
