Sometimes it can be very petty. I`m not trying to put the agents in a bad light, I`m just saying it can happen. I know of a case where it happened. In this case, it was a sale agreement. Neither the real estate agent nor the brokers would cancel it, so the seller rented the house for a year. They stood against a wall, but waited for the seller`s consent to expire before the sale. In other cases, agents use these forms simply as a comfortable and logical input to discuss how agents are paid, why it is important for the agent to actually write the offer, and other details of the buyer-broker relationship, so the buyer is perfectly clear about how everything works (and many home buyers are not clear at first!). If your buyer`s agreement clause is silent for termination, make sure your state has a special form for terminating the buyer`s agency contracts or contact your agent directly to see if your office offers such a form. This form can be referred to as « cessation of agency and release. » The termination form will ask you to provide some information about why you want to terminate the contract. The form should also describe the fees you can pay after the termination.
If your agent and state do not offer such a form, write your agent a letter asking if they are prepared to terminate the contract and the proposed terms of withdrawal. 1) Talk to your agent first. As in most relationships, most topics are communication issues. If you clearly realize what your worries are, you may be able to do things. Otherwise, the agent may offer to refer you to another agent or you or your agent agree to sign a retraction contract. The ARO may be specific to a specific transaction (for example. From personal experience, I know that some agents could take you hostage with a buyer`s agreement, I let the customers come to me and say, « I can`t get out of this agreement, the agent refuses to terminate it. » Whether you can terminate your buyer`s agency contract depends largely on the terms of the contract, your relationship with your agent and your particular circumstances.
